በኢፌዲሪ ህገመንግስትም ይሁን ኢትዮጵያ በአፀደቀቻቸው አለማቀፋዊ የሰበዓዊ መብት ስምምነቶች እንዲሁም በሌሎች አዋጆች ላይ የተቀመጡ አያሌ የሰብዓዊ እና ዲሞክራሲያዊ መብቶች ተፈፃሚነት እንዲኖራቸው በህግ እና በስርዓት የሚመሩ፤ ዋና ግባቸው እና የሥራ መለኪያቸው ህግ እና ሥርዓትን ማስከበር የሆኑ ተቋማት መኖራቸው ጥያቄ ውስጥ የማይገባ ቅድመ ሁኔታ ነው። እነዚህ ተቋማት እርስ በራሳቸው በሚኖራቸውም ግንኙነት ግልፅ የሆነ የሚና ወይም የተግባር ልዩነት ሊኖራቸው የተገባ መሆኑም የሚታመን ነው። በዚህ መርህ ውስጥ የሰብዓዊ እና ዲሞክራሲያዊ መብቶች አፈፃፀምን በሚመለከት ቀዳሚ ኃላፊነት ከተሰጣቸው የመንግስት አካላት ውስጥ በተለይም የህግ አስፈፃሚው እና የህግ-ተርጓሚው ሚና በእጅጉ የሚልቅ ነው። እነዚህ ተቋማት በሌሎች ሀገራት ላይ ያላቸው መስተጋብር እና ጤናማ የሆነ ውድድር የዜጎች የሰብዓዊ እና ዲሞክራሲያዊ መብቶች በተሻለ እንዲከበሩ አስተዋፅኦ አድርጓል።

The outbreak of the COVID-19 pandemic has brought overall economic, political and social crisis in most parts of the world, including Ethiopia. Although there are criticisms on their effectiveness, the government of Ethiopia has been taking measures to ease the economic impact of COVID-19 on the business entities operating in the country. Earlier in April, a protocol was issued by the Ministry of Labor and Social Affairs cited as the COVID-19 Workplace Response Protocol, which regulates the relationship between employees and employees during the COVID-19 pandemic. This protocol was a subject of criticisms due to its silence on the obligation and role of the government in sharing the burdens of employers.  

ዓለማችን ላይ የፈረንጆቹ 2020 የተወሳሰቡ ችግሮችን ይዞባት መጥቷል፡፡ ከቻይና ውሃን በትንሹ ተነስቶ በወራት ውስጥ ዓለምን ካዳረሰው የኮሮና ቫይረስ የሚስተካከል ችግር ግን ይመጣል ብሎ የገመተ አልነበረም፡፡ ይህ ቫይረስ በቀጥታ በሰው ልጆች ጤና እና ህይዎት ላይ እያሰከተለ ከሚገኘው ኪሳራ እና ውድመት በሚስተካከል ደረጃ ማህበራዊ እና ኢኮኖሚያዊ ችግሮችንም እያስከተለ ይገኛል፡፡ ከአሜሪካ ስቶክ ማርኬት እስከ ኢትዮጵያ አየር መንገድ፤ ከአውሮፓዊያኑ የንግድ ልውውጦች እስከ ኢትዮጵያ የአበባ ንግድ፤ ከካናድ የጥራጣሬ ግብይት እስከ አዲስ አበባ የአትክልት ተራ ንግድ ድረስ ብዙ መመስቃቀሎችን እያስከተለ ይገኛል፡፡ በዚህ መመሰቃቀል ውስጥ ብዙ አካላት ተጎጂ የሚሆኑ ቢሆንም በተለያዩ ሁኔታዎች ላይ ተቀጥረው እንደሚሰሩ ሰራተኞች ግን የችግሩ ቀጥተኛ ገፈት ቀማሽ አይገኝም፡፡ በተለይ ከአሜሪካ የቅጥር ገባያ እየሰማን እንዳለነው ብዙ ድርጅቶች ሰራተኞቻቸውን እየቀነሱ እያጋጠማቸው ያለውን የገንዘብ እጥረት በማቃለል ላይ ይገኛሉ፡፡ ይህ በሀገሪቱ የሚገኘውን የሥራ አጥ ቁጥር ወደ ስላሳ በመቶ እያደረሰው ይገኛል፡፡ ይህ ችግር ወደ ኢትዮጵያ መከሰቱ የማይቀር ነው፡፡ ብዙ የግል ድርጅቶች ስራቸውን ሙሉ ለሙሉ እያቆሙ በሚገኝበት በዚህ ጊዜ የሠራተኛን የደሞዝ ወጪ ያለምንም ችግር የመሸፈን አቅም ይኖራቸዋል ተብሎ አይጠበቅም፡፡ 

The House of Peoples Representatives has approved the infamous Excise Tax Proclamation (The Proclamation) last Thursday, February 13, 2020. Within hours from the approval of the proclamation, Ministry of Revenues have written a letter to manufacturers of excisable goods stating that the proclamation will be implemented starting from February 14, 2020, which in effect violates both the FDRE Constitution and Negarit Gazeta Establishment Proclamation. The proclamation has not yet been published in the Negarit Gazeta and there are notorious discrepancies between the Amharic and English versions. In addition, with no transition time given to the manufacturers, they are forced to prepare manual invoices, which separately shows the amount of excise tax payable in the transaction as the new law requires the amount of excise tax should be separately shown in the invoice.

Although there is no particular armed conflict or civil unrest in Ethiopia, it’s becoming common to see persons under 15 carrying a gun in different parts of the country. Although these pictures has been looked as fun by so many people, it becomes more serious when the children carrying the gun used some flags and have some connection with organized groups and parties in the country. Based on this assessment, there is a worry that in any case of an armed struggle or any hostilities there would be some kind of resentment to use those children under the age of 15 to actively participate in situations of conflicts. Thus, the following short legal analysis is made to inform any concerned party about the legal ramification of their activity in using children under the age of 15 to execute their military or any hostility related missions.

1. የመዘዋወር ነፃነት አለም አቀፋዊ አንድምታው

የሰው ልጅ ሰው ሆኖ በመፈጠሩ ከሚያገኛቸው አያሌ የተፈጥሮ መብቶች ውስጥ ከቦታ ቦታ የመዘዋወር ነፃነት በቀዳሚነት ይጠቀሳል፡፡ የሰው ልጆችን ከቦታ ቦታ የመዘዋወር ነፃነት ከሐይማኖት፤ ከባህል እና ከሌሎች የተፈጥሮ ህግጋት ጀምርን ስንመለከተው ፅኑ መሰረት ያለው ሆኖ እናገኘዋለን፡፡ በአለማችን ታሪክ ይህ ከቦታ ቦታ የመዘዋወር መብት በአንዳንድ የታሪክ አጋጣሚዎች ላይ ተገድቦ የነበረ ቢሆንም በአብዛኛው ግን ሰዎች ከቦታ ቦታ የመዘዋወር መብታቸው ሲከበር ቆይቷል፡፡ ይሄንን ተፈጥሮአዊ መብት በመጠቀም የተለያዩ የአውሮፓ ሰዎች አዲስ ግኝትን፤ የመካከለኛውና የሩቅ ምስራቅ ሀገሮች ደግሞ ንግድን በማጧጧፍ ለሀገራቸው እና ለአህጉራቸው ዘርፈ ብዙ ጠቀሜታ አበርክተዋል፡፡ ይህንን ጥቅም ከግምት ውስጥ በማስገባት እንደ ማግና ካርታ (Magna Carta) አይነት ጥንታዊ ሰነዶች ከቦታ ቦታ የመዘዋወር መብትን አውጀዋል፡፡ ከዚህ በተጨማሪ በታላቋ ሮም የነገሱ አብዛኛው ነገስታት ከቦታ ቦታ የመዘዋወር ነፃነትን ሲያከብሩ መቆየታቸውን የታሪክ ድርሳናት ያስረዳሉ፡፡
